Lojistik ve Taşıma Hukuku Derneği
Bu dernek; adıyla ve hedefiyle bir inanç birlikteliği etrafında toplananlar tarafından kurulması ve faaliyetleri yıllardır konuşulan ancak kuruluşu Mart-2014 itibarı ile gerçekleştirilen bir dernektir. Hatta kurucular arasında yer alması gerekip; o anda imzaya hazır olmadığı için hemen sonra üye kaydı yapılacak kişilerin bu düşüncenin gelişiminde katkısı büyüktür. Sektör; kamyoncu esnafından nakliye işletmesine; nakliye işletmesinden taşıma işletmesine; taşıma işletmesinden taşıma işleri organizatörü ve lojistik işletmesine evrilirken; hukuk bu değişimi gecikmeli takip etmekte ve sektörün gerisinde kalmaktadır. Aslında hukukun geride olması olağandır ama arkadan itici, yol gösterici bir güç olması gerekir kanaatiyle bu Derneği faaliyete geçirme kararı aldık. Böylece kamu otoriteleri ile özel sektörü aynı hedeflere odaklı bir şekilde motive eden, sektörün güçlenmesine katkı veren bir şekilde sektörel hukukun gelişiminde, yorumlanmasında ve uygulanmasında katkı vereceğimize inanmaktayız. İşte bu inançla yola çıkmış bulunmaktayız. Dernek; sektörde üst düzey yöneticiler, orta düzey yöneticiler, taşıma ve lojistik yönetimi alanında uzmanlaşmış öğretim üyeleri ve lojistik ve taşıma alanında sektörel hukukla iştigal eden hukukçular ve hukukçu akademisyenlerin birlikte ortak çözümler ürettiği ve yeni çözümleri önerdiği bir kurum olma hedefindedir. Bu hedef doğrultusunda Dernek; sektör firmaları, sektör kuruluşları, sektöre dair kamu kurumları arasında iletişim kanallarını açacak ve ortak vizyon üretmeye katkı verecektir. Dernek, sektörel tüm işletmeleri (taşıma işletmeleri, taşıma işleri organizatörleri, lojistik işletmeleri, taşıma işleri komisyoncuları, nakliyat ambarı işletmeleri, kargo işletmeleri, taşıma acenteleri ve diğer adlarla anılanlar dâhil), aslında hukukun tespit ve tayin edebileceği ortak bir vizyonda buluşturmayı amaçlamaktadır. Kamu otoritelerinin de mevzuat düzenlemeleri ile bu ortak vizyona katkısı zorlanacaktır. Belki de derneğimiz; kamu otoritesi ve sektör kurumları ile bir üst düzenleyici ve denetleyici kurumun oluşmasına katkı verecek, böylece tüm taşımaları yolcu, eşya ayırımı yapmaksızın tüm taşıma modları ve ardiye ve antrepo hizmetlerini denetleyen ve düzenleyen bir yapıya ulaşılacaktır. İşte bu aşamada sektör ile kamu ortak hedeflere daha rahat yürüyecektir. Biz de mevzuata dayalı sektördeki eksikliklerin tespitine ve giderilmesine, uygulamanın gelişimine, yaşanan hukuki problemlerin çözümüne ve nihayetinde Türkiye lojistik sektörünün gelişimine katkı sağlamak adına faaliyetlerde bulunmak için bu Derneği kurmuş olmaktan büyük mutluluk ve gurur duyuyoruz. Dernek hedeflerimizi hedef olarak kabul edecek sizleri de aktif üyelerimiz olarak aramızda görmekten mutlu olacağız. Ne kadar aktif ve ne kadar çok olursak o kadar güçlü oluruz.
